These Terms and Conditions (“Terms”) govern the use of the website and all reservations made through it for Villa Kama / Kama-23 LLC (“we,” “us,” “our”). By accessing the website, submitting a booking request, or using our services, you confirm that you have read, understood, and agreed to these Terms, together with our Booking Policy, Cancellation Policy, Privacy Policy, and Cookie Policy.
1. Scope
These Terms apply to all website users and to all bookings relating to:
villa accommodation,
tours,
airport transfers,
and any related services offered by us through the website.
2. Eligibility
Bookings may only be made by persons who have legal capacity to enter into binding contracts under applicable law. By making a reservation, the guest represents and warrants that all information provided is true, accurate, and complete.
3. Booking contract
A booking request submitted through the website constitutes an invitation to treat and not a binding offer by us. A binding contract shall arise only when we confirm the reservation in writing and, where applicable, receive any required deposit or payment.
We reserve the right to reject or cancel a booking where:
the requested dates are unavailable,
payment is not received in time,
the information provided is inaccurate,
the booking appears fraudulent or abusive,
or for any other lawful reason.
4. Prices and payment
All prices displayed on the website are subject to change without prior notice until a booking is confirmed. The final applicable price is the one stated in the booking confirmation.
Prices may include or exclude taxes, fees, or tourist levies, depending on what is shown at the time of reservation.
Payment terms, including deposit requirements, due dates, and accepted methods of payment, shall be those specified during the booking process or in the booking confirmation. Failure to pay within the required timeframe may result in cancellation of the reservation.
5. Accommodation use
The villa accommodation is provided solely for lawful short-term stay purposes and may not be used for unlawful, commercial, disruptive, or unsafe activities.
Guests shall:
respect the property and its furnishings,
comply with house rules and safety instructions,
avoid disturbing neighbors or other persons,
and leave the property in a clean and orderly condition at check-out.
Guests shall be responsible for any damage caused by themselves, their visitors, or persons under their control, except for normal wear and tear.
6. Check-in and check-out
Check-in and check-out times shall be those communicated in the booking confirmation or published on the website.
Early check-in or late check-out is subject to availability and may incur additional charges. We reserve the right to deny access outside the agreed times where operationally necessary.
7. Additional services
Tours and airport transfers are provided subject to availability, weather conditions, third-party availability, traffic, and operational feasibility.
Where services are performed by third-party providers, their own terms may apply in addition to these Terms. We shall not be responsible for delays, cancellations, or failures caused by third-party providers, except where such responsibility cannot be excluded under applicable law.
8. Guest conduct and prohibited use
Guests must not:
exceed the maximum occupancy of the property,
smoke in prohibited areas,
bring dangerous, illegal, or hazardous items,
organize events or parties without prior written consent,
sublet the property or transfer the booking to a third party,
or use the property in a manner that violates public order or applicable law.
We reserve the right to terminate the stay without refund in the event of serious breach of these Terms, unlawful conduct, or behavior that threatens the safety, property, or peaceful enjoyment of others, to the extent permitted by law.
9. Liability
To the maximum extent permitted by applicable law, we shall not be liable for:
indirect, incidental, or consequential losses,
loss of profit,
loss of enjoyment,
loss resulting from force majeure events,
or delays caused by circumstances beyond our reasonable control.
Nothing in these Terms shall limit liability where such limitation is not permitted under mandatory consumer protection or other applicable law.
10. Force majeure
We shall not be liable for failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, fire, flood, severe weather, war, civil unrest, strikes, governmental restrictions, epidemics, pandemics, transport interruptions, utility outages, or similar events.
In such cases, our obligations may be suspended, modified, or terminated as reasonably required by the circumstances and applicable law.
11. Data protection
We process personal data in accordance with our Privacy Policy and the applicable data protection laws of the Republic of Bulgaria and the European Union, including the GDPR.
12. Intellectual property
All content on this website, including text, photographs, logos, graphics, and layout, is owned by us or used with permission and is protected by applicable intellectual property laws. No content may be copied, reproduced, modified, or distributed without prior written consent, except where permitted by law.
13. Amendments
We reserve the right to amend these Terms at any time. The updated version shall be published on this page with the date of revision. Continued use of the website after publication of changes constitutes acceptance of the revised Terms.
14. Governing law and jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of Bulgaria, together with any applicable mandatory consumer protection provisions of European Union law.
Any dispute arising out of or in connection with these Terms shall be subject to the competent Bulgarian courts, unless mandatory law provides otherwise.
